AGO Terms
1. The following terms and conditions (AGO Terms) form part of and are incorporated within the TDI Betting Licence Agreement between the Customer, TDI and SRAD (Customer Contract).
2. Terms defined in the Customer Contract shall have the same meanings when used in these AGO Terms. Please read these AGO Terms carefully. By using any of the AGO Benefits (defined below), Customer agrees to accept and be bound by these AGO Terms.
3. As an authorised licensee of TDI Official Data, Customer is invited to participate in the Authorised Gaming Operator Programme (AGO Programme). The following additional benefits are offered to the Customer as part of the AGO Programme:
a. The right to publish Tournament category logos (e.g. ATP Masters 1000) on the Customer Platforms alongside the TDI Official Data for the purpose of identifying and/or describing Betting offers relating to the applicable Tournament category; and
b. The right to publish headshots of players participating in Matches only on the Customer Platforms alongside the TDI Official Data for the purpose of identifying and/or describing Betting offers relating to the applicable player; and
c. The right to publish the following designation on the Customer Platforms: ‘Authorised Gaming Operator of the ATP Tour’,
together the “AGO Benefits”.
4. The Customer’s exploitation of the AGO Benefits is strictly subject to the following conditions:
a. Customer shall only publish Tournament category logos and/or headshots alongside a relevant Betting offer, , relating to the TDI Official Data;
b. Customer shall only be entitled to use the logos and headshots as provided by TDI or SRAD and shall not adapt, enhance, alter, add to, vary, modify, record, store, copy, edit, manipulate, reproduce, sub-license, resell, redistribute or brand any Tournament category logos or player headshot;
c. Tournament category logos must be no larger than 200% of the original size as provided by TDI or SRAD;
d. Headshots must be no larger than 200% of the original size as provided by TDI or SRAD ;
e. Customer shall only use the Tournament category logos and player headshots for the purpose of identifying / describing relevant Betting offers and shall not use the logos or headshots for any other commercial purpose, including without limitation for any promotional purpose, whether on the Customer Platforms or elsewhere. Without limiting the generality of the foregoing, in no circumstances shall the Customer use the logos or player headshots on its social media pages or in any advertisements.
5. TDI and/or SRAD may, in response to a request from a player or Tournament, require Customer to cease using any one or more of the Tournament category logos and/or player headshots, by sending written notice to the Customer (email accepted). Customer shall promptly and in any event within seven (7) days of receipt of such notice, cease using the applicable logo(s)/headshot(s) and remove all copies of them from the Customer Platforms.
